Terms & Conditions

Note: These terms are provided as a reasonable starting point. For binding legal agreements, please consult a qualified Indian lawyer. By using Nivasa, you acknowledge that these terms are subject to revision as our platform matures.

1. Acceptance of Terms

By accessing or using Nivasa ("the Platform"), operated by Nivasa Technologies ("Nivasa", "we", "us"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, please do not use the Platform.

2. Eligibility

You must be at least 18 years old and capable of entering into legally binding contracts under Indian law to use Nivasa. By registering, you confirm you meet these requirements.

3. Account Registration

You agree to provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at hello@buildwithnivasa.com of any unauthorized use.

Each phone number and email address may be associated with only one Nivasa account. We reserve the right to suspend or terminate duplicate accounts.

4. Property Listings

Sellers (Owners, Brokers, Builders) are solely responsible for the accuracy of their listings, including photographs, descriptions, pricing, RERA registrations, and contact information. Nivasa does not guarantee or verify the legal title, ownership, or condition of any listed property.

By posting a listing, you grant Nivasa a non-exclusive, royalty-free license to display, distribute, and promote the listing on the Platform and through marketing materials.

Nivasa reserves the right to remove any listing that violates these Terms, applicable laws, or community standards, including misleading content, fraudulent listings, or properties without valid documentation.

5. Buyer / Tenant Responsibilities

Buyers and tenants are responsible for independently verifying all property details, conducting due diligence, and consulting qualified professionals before entering into any transaction. Nivasa is a discovery platform; we do not act as a real estate agent, broker, or legal advisor.

6. Plans & Payments

Nivasa offers free and paid subscription plans (Starter, Growth, Pro). Paid plans are billed monthly or quarterly as selected. All payments are processed offline through our team — to upgrade, users submit a callback request, and our team will contact you to complete the transaction.

Plan benefits are subject to the limits described on the Pricing page. Nivasa reserves the right to modify plan features, limits, and pricing with reasonable notice.

Refunds: Subscription fees are non-refundable except as required by law. If a service issue arises, please contact us within 7 days for resolution.

7. Prohibited Conduct

You agree not to:

  • Post false, misleading, or fraudulent listings
  • Use the Platform to harass, abuse, or harm other users
  • Scrape, copy, or redistribute Platform content without permission
  • Attempt to circumvent paid plan limits through duplicate accounts
  • Use bots, scripts, or other automated means to interact with the Platform
  • Post listings for properties you do not own or have authority to list
  • Engage in money laundering or any illegal activity through the Platform

8. Intellectual Property

The Nivasa name, logo, wordmark, and Platform design are trademarks of Nivasa Technologies. All Platform content, including code, design, and original photography, is owned by or licensed to Nivasa. You may not reproduce or distribute these materials without written permission.

9. Limitation of Liability

To the maximum extent permitted by Indian law, Nivasa shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to losses from property transactions, broker fraud, or third-party actions. Our total liability shall not exceed the fees you have paid to Nivasa in the preceding twelve months.

10. Disclaimers

The Platform is provided "as is" without warranties of any kind. Nivasa does not guarantee uninterrupted access, accurate listings, successful transactions, or any specific outcomes.

11. Termination

We may suspend or terminate your account at any time if you violate these Terms, applicable laws, or engage in conduct harmful to the Platform or other users. You may delete your account at any time by contacting us at hello@buildwithnivasa.com.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts at Chandigarh, India.

13. Changes to Terms

We may update these Terms periodically. Material changes will be notified via email or a notice on the Platform. Continued use after changes constitutes acceptance of the revised Terms.
